Competition law prevalent in India prohibits anti-competitive agreements (including cartels) and abuse of dominant positions beside regulating merger or transactions of combinations of enterprises. The hefty fines, prosecution and damages likely to be levied by the Competition Commission/Tribunal, have direct consequences impacting reputation and sustainability of enterprises.

The enterprises therefore should be highly cautious while drafting the business contracts and giving approvals for publishing the advertisements for their products and/or services, so that they should be fall under the definition of violation of competition laws and have to face heavy penalty beside business loss.
